EmbDesignTube.com primarily operates as a digital marketplace for machine embroidery design files and related services. All products and services offered on this Website are digital in nature, including downloadable embroidery designs, bulk design packages, and embroidery digitizing services. No physical goods are manufactured, shipped, or delivered through this Website.
EmbDesignTube.com reserves the right to modify, update, or revise these Terms & Conditions at any time without prior notice. Continued use of the Website following any such changes shall constitute your acceptance of the revised Terms.
The Website and its services are accessible to users from India and other countries. Users accessing the Website from outside India do so at their own initiative and are responsible for compliance with applicable local laws.
EmbDesignTube.com, at its sole discretion, reserves the right not to accept a User from registering on the Website without assigning any reason thereof. You can find more information on the About Us page.

Nature of Products – Digital Goods Only:

EmbDesignTube.com sells only digital machine embroidery design files. We do not sell any physical goods, printed products, fabrics, garments, or embroidery materials.

All products available on the Website are:

-Digitally downloadable embroidery design files
-Delivered electronically via instant download or user account access
-Not shipped physically in any form

By placing an order, the user clearly understands and agrees that no physical product will be delivered.

Since all products are digital in nature, they are not subject to physical return, replacement, or exchange in the manner of tangible goods. Any refund or resolution request will be handled strictly in accordance with our Cancellation & Return Policy.

Users are solely responsible for ensuring that:

-Their embroidery machine supports the selected file format
-The design size and hoop size are compatible with their machine
-They have the necessary software to open, extract, and use downloaded files

EmbDesignTube.com shall not be responsible for incompatibility issues arising due to incorrect machine selection, unsupported file formats, or lack of technical knowledge on the user’s end.
All digital products are licensed for use and do not transfer ownership of the original design or intellectual property to the buyer. Redistribution, resale, sharing, or re-uploading of the downloaded files in any form is strictly prohibited.

Embroidery Design Bulk Download Pack Terms & Condition:

-The condition of this term is valid only for the embroidery design bulk download pack ( https://embdesigntube.com/freedom-packages )
-No modification in any design/designs/folder will be given – You can use our service to modify at a nominal rate.
-After payment confirmation for the specified folder, you will get your requested folder within 2–48 hours maximum.
-The offer is valid only if the customer buys/purchases an entire design/designs/folder.
-If the customer wants a single design from the folder, he/she needs to pay the entire folder rate or contact our customer care executive to know the available best option.

Additional Terms Applicable to Bulk Download Packs:

-All embroidery design bulk download packs are digital products only. No physical goods, storage devices, or printed materials will be shipped.
-Due to the digital nature of bulk embroidery design folders, bulk pack purchases are strictly non-refundable and non-exchangeable once delivered or made accessible.
-Bulk download packs are provided for personal and/or commercial embroidery use only. Redistribution, resale, sharing, or re-packaging of individual designs or folders in digital form is strictly prohibited.
-It is the customer’s responsibility to verify machine compatibility, hoop size, and file format before purchasing a bulk pack. EmbDesignTube.com shall not be responsible for incompatibility issues arising from incorrect machine selection.
-Download access is provided through the customer’s registered account. Customers are advised to download and securely store all files after delivery, as download access may be limited by system policies.
-Customer support for bulk packs is limited to delivery confirmation and file access issues. Design customization, resizing, recoloring, or format conversion services are not included unless purchased separately.

User Account, Password, and Security

You will receive a password and account designation upon completing the Website's registration process either as a seller or as a customer. You are responsible for maintaining the confidentiality of your password and account and are fully responsible for all activities that occur under your password or account.

You agree to:

(a) Immediately notify EmbDesignTube.com of any unauthorized use of your password or account or any other breach of security
(b) Ensure that you exit/log out from your account at the end of each session

EmbDesignTube.com cannot and will not be liable for any loss or damage arising from your failure to comply with it.

Services Offered:

EmbDesignTube.com provides several Internet-based services through the Website (“Service”), including:

-Downloadable Machine Embroidery Designs
-Bulk Embroidery Design Downloads
-Custom Embroidery Digitizing Services
-Free Embroidery Design Downloads (subject to signup)

Upon placing an order and making the payment, EmbDesignTube.com shall display an Instant Download Link for the purchased product.
Users may download each purchased product up to 20 times from their account.
All products are non-refundable, except under specific conditions as outlined in the Cancellation & Return Policy.

 

Machine Compatibility & File Formats

EmbDesignTube.com provides embroidery designs compatible with various embroidery machines, including but not limited to:

  • Brother embroidery machines

  • Janome & Usha Janome machines

  • Ricoma commercial and industrial machines

  • Singer embroidery machines

  • Bernette embroidery machines

Supported file formats may include: DST, PES, JEF, EXP, VP3, HUS, XXX, VIP, EMB, DSB, PV3, and others as specified on individual product pages.

It is the user’s responsibility to verify:

  • Machine compatibility

  • Hoop size compatibility

  • File format suitability

before purchasing or downloading any design.

Seller:

(a)As a verified seller from EmbDesignTube, you are agreeing to upload and send us the product that is not having any legal issues. EmbDesignTube reserves the right to terminate any seller account or the products submitted by the seller at any time if it is against any law or we get a spam/abuse report for the product uploaded by the seller. If you find any abuse/copyrighted material on our website, you may contact us for removal. We will fully cooperate with you for content removal.

(b)Seller will need to upload their product with all necessary details as specified on the seller guidelines page. This will help you to attract more customers to buy your product. However, EmbDesignTube.com has the full right to change/remove/edit any description submitted by the seller that seems to violate DMCA rules & regulations/copyrighted material. By submitting products from seller accounts, the seller agrees that it will become the property of EmbDesignTube as soon as it is approved by the admin.

(c)The MRP set by you is just for our reference purpose. We have full rights to change/edit/modify the MRP of the product submitted by the seller to bring more sales.

(d) EmbDesignTube.com has the right to set the commission of each seller manually and changeable from time to time. By Default, We are setting a 60:40 commission. E.g., 60% of the amount will be paid to the seller by us, and we will keep a 40% amount as administration fees & our service charges. If your product is going viral and getting more purchases, we will increase your commission according to your relationship with us.

(e) Make sure your uploaded zip file as the product is not password protected. It's against our seller's TOS.

(f) Seller is responsible for all issues raised from the products uploaded by them. The issue may be any legal, consumer, or complaint.

(g) The seller should upload the compressed file with exact images as they are compressed in the zip file. So overall, the product should be as same as shown in the image.

Privacy Policy:

The User hereby consents, expresses, and agrees that he has read and fully understands the Privacy Policy of EmbDesignTube.com. The user further consents that the terms and contents of such Privacy Policy are acceptable to him.
